Massachusetts Mandatory Real Estate Licensee-Consumer Relationship Disclosure.
Massachusetts law requires that real estate licensees disclose to consumers the type of relationship and representation available to them. This disclosure is provided by Valhalla DCM LLC d.b.a. STRUCTR, a licensed Massachusetts real estate brokerage (MA Broker License #9628438).
Types of Agency Relationships
Seller’s Agent: A seller’s agent represents the seller and works in the seller’s best interest, including negotiating the highest possible price and best terms for the seller.
Buyer’s Agent: A buyer’s agent represents the buyer and works in the buyer’s best interest, including negotiating the lowest possible price and best terms for the buyer.
Designated Agent: The principal broker may designate one or more agents to represent the buyer and a different agent to represent the seller in the same transaction.
Facilitator: A facilitator (non-agent) assists buyers and sellers in a transaction without representing the interests of either party. A facilitator owes both parties a duty of honesty and fair dealing.
No Representation Without a Written Agreement
An agency relationship is created only by a written agreement. Until such an agreement is signed, the licensee does not represent you, and you should not disclose confidential information.
